WHAT HAPPENS WHEN YOU APPOINT SOMEONE TO REPRESENT YOU?
It is not necessary to engage the services of an agent to assist you with your immigration application. The process is fairly straightforward, and all the forms and information you need are available through this website.
This being said, anyone may choose to appoint an agent to represent him/her in the submission and processing of an immigration application.
You should take care in whom you choose for this purpose. Canada's Department of Citizenship and Immigration does not approve, license or regulate the activities of agents. Standards of reliability, competency and integrity vary widely.
If you do appoint someone to represent you, you should be aware of the following:
1. Since all applications are treated equally, the appointment of a person or firm to assist you will not lead to expedited processing of your application; nor will it influence the decision as to whether or not your application is successful.
2. If and for as long as you have designated an agent to represent you, we will communicate only with that person or firm. Any processing enquiries you may have must be made through your agent. Any such enquiries that you send directly to this office will neither be answered nor acknowledged.
3. This website contains a great deal of information on our processing procedures and time frames (see especially the webpage "Processing Times and Service Standards") and offers the most convenient access to information you need. If your question is of a procedural nature, and the website does not answer the specific enquiry, your agent should have the expertise to advise you what should be done. If your enquiry is particularly complex or unusual, or requires access to information available only on our files, your agent may make a written enquiry for information on your behalf. However, pursuant to the provisions of Canada's Privacy Act , we can provide status information on cases in process to agents only if they are citizens or residents of Canada, and will do so only if case in question has exceeded the time frames set out on the "Processing Times and Service Standards"webpage.
4. This office will not become involved in disputes between applicants and their agents regarding such matters as payment of professional fees and withholding of immigrant visas or other correspondence. These are matters to be resolved between the parties.
5. Delegation of authority to an agent makes you responsible for any malpractice or negligence on the part of that agent. For example, if a agent provides misleading information on your behalf, and even without your knowledge, your application will be refused; similarly, if a deadline is missed through the agent's failure to forward correspondence to you in a timely manner, your application will be refused for non-compliance.
6. If for any reason you wish to revoke the authorization of your agent, either to handle matters yourself or to appoint a new representative, you must inform us in writing, at which time we will send you a revocation form to complete. A copy of your completed form will in due course be forwarded to the person or firm whose authority you have revoked.

Registered migration agents are bound by the Migration Agent’s Code of Conduct and generally charge for their services. The MARA investigates complaints against registered migration agents and may take disciplinary action against them. If you have a concern about a registered migration agent, you can contact the MARA.
Under Australian law, anyone who uses knowledge of migration procedures to offer advice or assistance to a person wishing to obtain a visa to enter or remain in Australia must be registered. If you intend to use a migration agent you are advised to use a registered migration agent.
